TERMS OF USE

 

Welcome to Guardian Guided Matchmaking, an exclusive matchmaking platform specifically designed for Sunni Muslims seeking matrimonial connections. Guardian Muslim Marriage operates through its website, mobile application, and associated services (collectively referred to as the "Platform").

 

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User" or "you") and ALI.T INVESTMENTS LLC ("Guardian Guided Matchmaking", "we", "our", or "us"). By accessing, using, or registering with the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, Community Guidelines, Payment Terms and Refund Policy and any other applicable policies, guidelines and/or agreements.

 

  1. 2. ELIGIBILITY REQUIREMENTS

 

2.1. To access, register, or use the services provided by Guardian Guided Matchmaking, you must meet all of the following eligibility criteria. By creating an account and using the Platform, you expressly represent, warrant, and affirm that you satisfy all conditions set forth below and that the information you provide is truthful and accurate. Any misrepresentation or failure to meet these requirements may result in immediate suspension or termination of your account without refund and may further lead to restrictions on future use of the Platform.

 

2.2. Age and Legal Capacity

 

(a) You must be at least 18 years old, or the age of majority required to enter into a legally binding contract under the laws of your jurisdiction, whichever is greater. If you are under the age of majority, you are strictly prohibited from using the Platform.

 

(b) You must have the full legal capacity to enter into a binding contract and be legally permitted to use the Platform under the laws of your home country.

 

(c) Guardian Muslim Marriage actively monitors for underage use. If we suspect that you may be underage or ineligible, we reserve the right to request verification, suspend, or terminate your account.

 

2.3 Religious and Ethical Compliance

 

(a) You must be a Sunni Muslim, or you must be using the Platform in a manner consistent with Islamic principles and values.

 

(b) Your use of the Platform must align with the moral and ethical standards set by Guardian Muslim Marriage, and you must not engage in any activity that contradicts the core principles of Islamic matchmaking.

 

2.4. Legal and Criminal History Restrictions

 

(a) You must not have been convicted of, or pled guilty or no contest to, any criminal offense, including but not limited to fraud, harassment, violence, sexual misconduct, hate crimes, terrorism-related offenses, or any other offense that, in Guardian Muslim Marriage’s sole discretion, may pose a risk to other users of the Platform.

 

(b) You must not be required to register as a sex offender in any jurisdiction.

 

(c) You must not be subject to any applicable restrictions that would legally prohibit you from using the Platform.

 

2.5. Geographical and Regulatory Compliance

 

(a) You must not be located in, or a resident of, a country that is subject to sanctions, embargoes, or restrictions imposed by the United Nations, the United States, the European Union, the United Kingdom, Canada, or any other relevant jurisdiction.

 

(b) You must not be identified on any government list of prohibited, sanctioned, or restricted parties, including but not limited to the U.S. Treasury Department’s Specially Designated Nationals list or similar regulatory lists.

 

(c) You must comply with all applicable laws, rules, and regulations governing your access to and use of the Platform, including but not limited to Shariah-compliant matrimonial conduct.

 

2.6 Account Creation and Use

 

(a) You may create an account manually or through an approved third-party authentication method. If using third-party authentication, you authorize Guardian Muslim Marriage to access and use certain information from your linked account, subject to our Privacy Policy. 

 

(b) You may not share, transfer, or allow any other individual to access your account without express authorization from Guardian Muslim Marriage.

 

(c) You may not create multiple accounts, use another person’s account, or attempt to bypass Platform restrictions by creating a new account after suspension or termination.

 

(d) If you delete your account and subsequently attempt to create a new one using the same credentials within a restricted time frame, your prior account may be reinstated rather than a new one being created.

 

2.7. Monitoring and Enforcement

 

(a) Guardian Muslim Marriage employs a combination of automated systems, user reports, and manual moderation to monitor accounts, user activity, and content for compliance with these Terms. 

 

(b) We reserve the right, at our sole discretion, to restrict access, suspend, or terminate any account, or take any other enforcement actions necessary to uphold the integrity of the Platform. This includes but is not limited to blocking IP addresses, restricting access to the Platform, or pursuing legal action against individuals who violate these Terms.

 

(c) For users residing in the European Union ("EU"), Guardian Muslim Marriage will provide notification when taking enforcement action against your account, unless prohibited by law enforcement agencies. Users in the United Kingdom ("UK") may have the right to bring claims for breach of contract if their access is restricted or terminated in violation of local consumer protection laws.

 

2.8. Right to Appeal

 

(a) If you believe your account was suspended or terminated in error, you have the right to appeal within six (6) months from the date of enforcement action.

 

(b) Appeals must be submitted through the official appeals form provided in the notification shown to you within the app, or by contacting our support team with a detailed explanation of your appeal.

 

(c) Guardian Muslim Marriage reserves the right to review and determine the outcome of your appeal at its sole discretion.

 

2.9. Prohibited Access and Security Restrictions

 

(a) You may not attempt to access, tamper with, or use non-public areas of the Platform, its servers, or its internal systems. 

 

(b) Unauthorized access or interference with the Platform’s infrastructure may result in legal consequences, including civil or criminal liability.

 

2.10. Additional Technical Requirements

 

(a) You are responsible for ensuring that your device meets the minimum technical specifications required for accessing and using the Platform.

 

(b) Guardian Muslim Marriage does not guarantee uninterrupted access and may impose temporary restrictions for maintenance, security, or compliance purposes.

 

  1. 3. CONTENT

 

3.1. General Overview

 

The utilization, engagement, and overall interaction with the Platform necessitate a thorough and comprehensive understanding of the nature, scope, and extent of the content that may be disseminated, uploaded, shared, transmitted, or otherwise made available within the diverse and dynamic digital ecosystem of the Platform. Content, for the purposes of this Clause, shall be defined in the broadest sense possible to encompass, but not be strictly limited to textual compositions in any form (including articles, comments, captions, and descriptions), visual media of all types (including photographs, illustrations, infographics, animations, and video footage), auditory data (including recorded speech, music, sound effects, and audio-visual synchronized content), interactive modules (including polls, surveys, embedded applications, and user engagement tools), metadata (including geolocation data, timestamps, author identifiers, and descriptive tagging), embedded hyperlinks (whether internal or external in origin), algorithmically generated material (including artificial intelligence-assisted outputs and auto-generated suggestions), and any derivative works, adaptations, modifications, or enhancements thereof (collectively referred to as the "Content").

 

3.2. Categories of Content Available Within the Platform

 

In connection with the operation, functionality, and provision of the Services via the Platform, users shall encounter and have access to three distinct categories of content, each of which shall be governed by the terms and conditions set forth herein:

 

(a) User-Generated Content ("Your Content"): Content that you, as a registered or unregistered user, voluntarily upload, submit, share, display, transmit, or otherwise provide through the Platform, including but not limited to text, images, videos, audio, comments, messages, interactions, or any other form of communicative material, whether directed to specific individuals, groups, or the general public.

 

(b) Third-Party Content ("Member Content"): Content that is uploaded, submitted, shared, displayed, transmitted, or otherwise provided by other registered users of the Platform, including but not limited to personal profiles, messages, interactions, media, reviews, or other forms of communicative material that are accessible to you via the Platform.

 

(c) Platform-Owned Content ("Our Content"): Any and all content that is created, curated, provided, developed, owned, licensed, or otherwise made available by Guardian Muslim Marriage, its affiliates, subsidiaries, partners, licensors, or service providers, including but not limited to proprietary databases, software, algorithms, user interface elements, branding, logos, trademarks, service marks, trade names, text, images, audiovisual material, and any other proprietary intellectual property.

 

3.3. Your Content

 

3.3.1. Obligations and Liabilities

By choosing to upload, post, transmit, share, or otherwise make Your Content available on or through the Platform, you hereby expressly acknowledge, understand, and agree that you bear sole and exclusive responsibility for ensuring the accuracy, authenticity, reliability, legality, and overall compliance of such Content with all applicable laws, regulations, and policies, including, but in no way limited to, the prevailing Community Standards, Acceptable Use Policies, and any other applicable terms as periodically established, reviewed, updated, or modified by Guardian Muslim Marriage at its absolute and unfettered discretion.

 

3.3.2. Grant of License

 

By submitting Your Content to the Platform, you grant Guardian Muslim Marriage, including but not limited to its subsidiaries, affiliates, successors, assigns, and authorized licensees, an irrevocable, perpetual, non-exclusive, royalty-free, worldwide, fully sub-licensable, and fully transferable right and license to use, reproduce, copy, store, distribute, transmit, modify, adapt, translate, prepare derivative works of, publicly display, publish, broadcast, monetize, and otherwise exploit such Content in any form, medium, or technological format now known or hereinafter developed, for any and all legally permissible purposes, including, but not limited to, the enhancement of the Platform, strategic marketing, promotional activities, commercial and non-commercial research, software development, corporate analytics, and other related objectives, all without further notice to you, without requiring any additional consent, and without any obligation to provide compensation, credit, or attribution.

 

3.3.3. Prohibited Content

 

You are expressly and unequivocally prohibited from posting, uploading, transmitting, sharing, or otherwise making available any Content that:

 

(a) Contains, reveals, or discloses personal data, sensitive information, confidential records, or financial details (including but not limited to residential addresses, banking credentials, credit card information, government-issued identification numbers) in violation of applicable data protection, cybersecurity, or privacy laws;

(b) Infringes upon, misappropriates, or otherwise violates any third-party intellectual property rights, including but not limited to copyrights, trademarks, patents, design rights, trade secrets, or rights of publicity;

 

(c) Contains false, misleading, deceptive, defamatory, libelous, fraudulent, or otherwise unlawful statements or representations;

 

(d) Promotes, facilitates, or is otherwise connected to any form of unlawful, unethical, or harmful conduct, including but not limited to harassment, intimidation, hate speech, incitement to violence, discrimination, or exploitation;

 

(e) Utilizes automated scripts, bots, software algorithms, or other technological mechanisms designed to manipulate interactions, engagement metrics, or user behaviors on the Platform;

 

(f) Involves the exchange of contact information, personal details, or any form of direct communication outside of the Platform unless explicitly authorised by Guardian Muslim Marriage; and/or 

 

(g) Is, in the absolute and sole determination of Guardian Muslim Marriage, objectionable, inappropriate, offensive, disruptive, or contrary to the best interests of the Platform, its users, or its operational policies.

 

3.3.4. Retention and Removal

 

Guardian Muslim Marriage reserves and retains the unconditional right, though not the obligation, to actively monitor, review, edit, remove, modify, block, restrict, or otherwise refuse to display any Content at its sole and absolute discretion, with or without prior notice, and without any liability to you. Guardian Muslim Marriage further disclaims any obligation to maintain, store, archive, or provide access to any submitted Content and strongly recommends that users maintain independent backups of any content of personal or professional significance.

 

3.4 Member Content

 

3.4.1. Limited License to Access

Member Content remains the sole and exclusive intellectual property of the respective user who originally created or posted it. You may access, view, and interact with Member Content strictly in accordance with the intended functionality and permitted uses of the Platform. You shall not, under any circumstances, copy, modify, reproduce, redistribute, repurpose, publicly display, perform, commercially exploit, or otherwise utilize Member Content for any promotional, marketing, or unauthorized purpose without the express prior written consent of the original rights holder.

 

3.4.2. Limitations of Liability

 

Guardian Muslim Marriage does not assume, endorse, warrant, or guarantee the accuracy, authenticity, or validity of any Member Content. Any reliance placed upon Member Content shall be at your sole and exclusive risk, and you shall indemnify and hold harmless Guardian Muslim Marriage, its affiliates, directors, officers, employees, and agents from any claims, damages, liabilities, or losses arising in connection therewith.

 

3.5. Our Content

 

3.5.1. Intellectual Property Rights

 

All proprietary elements contained within the Platform, including but not limited to its software architecture, databases, trademarks, service marks, logos, graphical assets, text-based content, and all associated intellectual property, are owned, controlled, or lawfully licensed by Guardian Muslim Marriage and are protected under applicable copyright, trademark, and trade secret laws. No rights or licenses are granted to you except as expressly set forth herein.

 

3.5.2. Permitted Use

 

Guardian Muslim Marriage grants you a limited, non-exclusive, non-transferable, and revocable license to access and utilize Our Content strictly for personal, non-commercial purposes, subject to these Terms and Conditions. You shall not:

 

(a) Copy, modify, distribute, or create derivative works of Our Content;

 

(b) Reverse-engineer, decompile, or attempt to extract source code from any software associated with the Platform; and/or

 

(c) Remove or obscure any proprietary notices contained within Our Content.

 

3.6. Enforcement and Compliance

 

Guardian Muslim Marriage reserves the absolute right to monitor, investigate, and take enforcement action against any violations of these Terms, including but not limited to Content removal, account suspension, and legal action.

 

     

  1. RESPONSIBILITIES, PROHIBITIONS, AND RESTRICTIONS ON USE

 

4.1. General Responsibilities and Obligations of the User

 

Without prejudice to any other provisions contained herein, and subject always to the overriding rights, discretions, and entitlements of Guardian Muslim Marriage as expressly or impliedly provided for under this Agreement, the User acknowledges, agrees, undertakes, and covenants, irrevocably and unconditionally, that their engagement with, access to, or use of any aspect of the Platform, including but not limited to the Services, shall be strictly and unconditionally governed by the following non-exhaustive responsibilities, obligations, commitments, and duties, the breach or failure of which, whether by act, omission, negligence, misfeasance, malfeasance, or any form of direct or indirect non-compliance, shall constitute a material and fundamental breach of this Agreement, entitling Guardian Muslim Marriage to invoke and enforce any and all rights, remedies, sanctions, and consequences, as further described herein or otherwise available under applicable law.

 

 

 

4.1.1. Compliance with Applicable Laws, Regulations, and Policies

 

(a) The User shall at all times fully comply with any and all laws, statutes, subsidiary legislation, regulations, rules, codes of practice, guidelines, directives, policies, advisories, notifications, circulars, contractual obligations, and legal requirements that may be applicable to their use of the Services, whether now existing or as may be enacted, amended, revised, superseded, repealed, or otherwise varied from time to time by any competent governmental, judicial, regulatory, or enforcement authority in any applicable jurisdiction.

 

(b) Without prejudice to the generality of the foregoing, the User shall not engage in any act, omission, representation, or conduct that may, in any way, cause, contribute to, or result in any breach, violation, infringement, or contravention of any law governing privacy, data protection, anti-money laundering, anti-bribery, competition, consumer protection, intellectual property, contract law, tort, cybercrime, telecommunications, and/or any other relevant domain of law.

 

4.1.2. Accuracy, Integrity, and Security of Information

 

(a) The User shall be solely responsible for ensuring that any and all information, data, credentials, identifiers, content, materials, communications, or representations provided, submitted, uploaded, or transmitted in connection with the Services are, at all times, complete, truthful, accurate, valid, non-misleading, and free from any element of fraud, misrepresentation, impersonation, or deception.

 

(b) The User shall implement and maintain all necessary safeguards, including but not limited to robust passwords, multi-factor authentication, encryption, and secure network configurations, to prevent unauthorized access, disclosure, modification, or compromise of their user account, login credentials, or any sensitive data related to the Services.

 

(c) The User shall not share, transfer, disclose, sell, lease, assign, or permit any third party to access or use their account, credentials, data, or any proprietary content associated with the Services, and shall be solely liable for any and all consequences arising from unauthorized access or use, whether resulting from their negligence, omission, willful misconduct, or breach of this Agreement.

 

4.1.3. Good Faith, Ethical Use, and Non-Interference

 

(a) The User shall, at all times, act in good faith, exercise due diligence, and conduct themselves in a responsible, ethical, and law-abiding manner while accessing or using the Services.

(b) The User shall refrain from engaging in any conduct that disrupts, compromises, interferes with, or undermines the normal functioning, integrity, security, performance, availability, or accessibility of the Services, including but not limited to attempting to hack, reverse engineer, or otherwise manipulate any technical infrastructure, software, algorithm, or proprietary system operated or deployed by Guardian Muslim Marriage.

 

4.2. Restrictions on Prohibited Content and Conduct

 

In ensuring the safe, lawful, and appropriate use of the Platform, Guardian Muslim Marriage hereby imposes strict limitations and prohibitions on certain types of content and user behavior. As a condition of using the Platform, you unequivocally agree and acknowledge that you shall not engage in the uploading, sharing, posting, transmitting, or disseminating of content that falls within the following prohibited categories:

 

(a) Unlawful Content: Any content that violates, encourages, promotes, facilitates, or incites conduct that would be considered unlawful under any applicable national, regional, or international laws, statutes, ordinances, regulations, or treaties, including but not limited to content that promotes criminal activity, fraud, human trafficking, drug-related offenses, or the unauthorized dissemination of classified information.

 

(b) Content Harmful to Minors: Any content that is exploitative, abusive, predatory, or otherwise harmful to individuals under the age of majority, including but not limited to content that promotes child sexual exploitation, child pornography, grooming behavior, or any other material that depicts or endangers minors in any manner.

 

(c) Defamatory or Libelous Content: Any content that constitutes, contains, or facilitates defamatory, libelous, slanderous, misleading, or otherwise false statements concerning an individual, group, entity, or organization that could cause reputational harm or subject such parties to public ridicule, scorn, or financial loss.

 

(d) Intellectual Property Violations: Any content that infringes upon, misappropriates, or otherwise violates the intellectual property rights, including but not limited to copyrights, trademarks, trade secrets, moral rights, or patent rights of any third party, unless you are the rightful owner or have obtained explicit written consent from the rights holder.

 

(e) Non-Consensual or Unauthorized Content: Any content that depicts, features, or includes any individual or group without their express and verifiable consent, including but not limited to unauthorized recordings, deepfakes, revenge pornography, or content obtained through hacking, surveillance, or other unlawful means.

 

(f) Hate Speech and Harassment: Any content or communication that harasses, bullies, threatens, or otherwise causes psychological, emotional, or physical harm to any other person or group, including but not limited to hate speech targeting race, ethnicity, nationality, gender identity, sexual orientation, religion, disability, or any other protected characteristic.

 

(g) Obscene, Violent, or Pornographic Content: Any content that is obscene, sexually explicit, pornographic, graphically violent, gory, or otherwise degrading to human dignity, including but not limited to content featuring excessive nudity, explicit sexual acts, or gratuitous depictions of violence.

 

(h) Commercial or Spam Content: Any content that constitutes unauthorized commercial activities, including but not limited to unsolicited advertising, pyramid schemes, affiliate marketing, direct sales, phishing schemes, or the dissemination of spam, junk mail, or bulk messages.

 

(i) Impersonation and Deception: Any content or conduct that involves the misrepresentation of your identity, including but not limited to falsely claiming affiliation with an individual, business, organization, or government entity, or engaging in fraudulent activities such as catfishing, scamming, or identity theft.

 

(j) Malicious Code and Cyber Threats: Any content that contains, distributes, or facilitates the deployment of viruses, worms, malware, spyware, trojan horses, or any other harmful software designed to compromise, damage, or disrupt the functionality, security, or integrity of the Platform or any associated networks, systems, or devices.

 

(k) Unauthorized Data Mining and Scraping: Any automated or manual process, device, method, or software that attempts to access, scrape, index, extract, or harvest data from the Platform, including but not limited to web crawlers, bots, scripts, and other unauthorized data collection mechanisms.

 

(l) Political Manipulation and Election Interference: Any content, communication, or conduct that seeks to manipulate, interfere with, influence, or otherwise distort political discourse, election outcomes, or public policy decisions, including but not limited to disinformation campaigns, coordinated inauthentic behavior, and political financing through the Platform.

 

(m) Circumvention of Platform Restrictions: Any attempt to bypass, evade, or interfere with security measures, access controls, or enforcement actions implemented by Guardian Muslim Marriage.

 

4.3. Compliance and Enforcement Measures

 

Failure to adhere to the above prohibitions may result in one or more of the following enforcement actions by Guardian Muslim Marriage, at its sole discretion and without prior notice:

 

(a) Content Removal: Immediate removal, deletion, or disabling of access to prohibited content without notice.

 

(b) Account Suspension or Termination: Temporary suspension or permanent termination of user accounts found to be in violation of these Terms.

 

(c) Legal Action: Referral of prohibited activities to law enforcement authorities or initiation of legal proceedings against violators.

 

(d) IP and Device Bans: Blocking of access to the Platform from specific IP addresses, devices, or geographical regions.

 

4.4. Obligations, Responsibilities, and Affirmations by Users

 

By utilizing, accessing, or engaging with the Platform in any capacity, you hereby explicitly acknowledge, affirm, agree, accept, and unconditionally commit to the following:

 

(a) That you shall adhere to and comply with all applicable laws, rules, regulations, directives, and policies governing the use of the Platform, as well as any additional guidelines or instructions issued by Guardian Muslim Marriage.

 

(b) That you shall not engage in any conduct, activity, or practice that may compromise, disrupt, or threaten the security, integrity, or lawful use of the Platform.

 

(c) That you shall remain fully responsible and accountable for any and all content, messages, communications, and interactions made, initiated, shared, or engaged in through your account or device.

 

(d) That you shall follow all Guardian Muslim Marriage processes and unconditionally agree to all terms, policies, requirements and any written instructions, notices, or communications stated on the Platform.

 

(e) That you shall cooperate fully with Guardian Muslim Marriage in the event of any investigation, review, or inquiry concerning compliance, security, or regulatory matters.

 

(f) That failure to comply with the aforementioned commitments may result in the imposition of enforcement actions as detailed in Clause 4.3 above.

 

4.5. Enforcement and Consequences of Breach

 

In the event of any breach, contravention, or non-compliance with any of the obligations, restrictions, or prohibitions contained in this Clause 4, Guardian Muslim Marriage shall, at its sole and absolute discretion, be entitled to take any and all remedial, corrective, or punitive actions necessary to protect its interests, including but not limited to:

 

(a) immediate suspension, termination, or restriction of the User’s access to the Services, whether in whole or in part, without prior notice or justification;

 

(b) revocation or invalidation of any rights, privileges, licenses, or entitlements granted to the User under this Agreement;

 

(c) reporting of the User’s conduct to law enforcement, regulatory authorities, or other relevant bodies for further investigation or legal action;

 

(d) pursuit of monetary damages, equitable relief, injunctive relief, and any other legal remedies available to Guardian Muslim Marriage under applicable law; and/or

 

(e) any other enforcement measure deemed necessary, proportionate, or justified in the circumstances.

 

  1. ROLE OF GUARDIANS

 

5.1. The Platform is structured to facilitate a matchmaking process that incorporates the oversight of a designated guardian ("Guardian"), who may be appointed by a user to supervise, observe, or otherwise participate in interactions conducted through the platform, with the intention of ensuring adherence to principles aligned with Islamic guidelines.

 

5.2. The appointed Guardian, at the discretion of the user and subject to platform functionalities, may be granted privileges that enable them to monitor, review, or be included in communications between users engaging in the matchmaking process, whether directly or indirectly, in a manner that supports the intended oversight function.

 

5.3. Guardian Muslim Marriage, in its capacity as a technology service provider, disclaims any and all liability, responsibility, or obligation concerning any conduct, action, inaction, omission, disagreement, misunderstanding, or dispute that may arise, whether directly or indirectly, between a user and their appointed Guardian, including but not limited to any decisions made, advice given, or interventions undertaken by the Guardian in relation to the user's participation on the platform.

 

  1. PRIVACY

 

6.1. The protection and responsible management of personal information is a matter of utmost significance to us. As such, we have established a distinct and comprehensive policy specifically addressing the collection, utilization, disclosure, and safeguarding of personal data, which we strongly encourage you to review in its entirety to ensure a full understanding of how your information may be processed within the scope of our platform and services.

 

6.2. In connection with your engagement with our Services, and in accordance with applicable legal and regulatory frameworks, our platform, along with its associated entities, subsidiaries, affiliates, and any third-party service providers acting on our behalf, may collect, process, retain, disclose, and otherwise utilize personal data provided by you or obtained through your use of the platform, as outlined in our Privacy Policy.

 

6.3. By continuing to access, interact with, or otherwise engage with our Services in any capacity, whether through direct or indirect means, you acknowledge and affirm your understanding that the collection, storage, and processing of your personal data shall be carried out in accordance with the terms, conditions, and provisions set forth in our Privacy Policy, which serves as the authoritative document governing our data-handling practices. It remains your responsibility to review, comprehend, and, where necessary, seek clarification regarding the manner in which your data may be processed, as your continued use of our Services shall constitute acceptance of the terms therein.

 

  1. RIGHTS, LICENSES, AND AUTHORISATIONS GRANTED TO AND BY USERS

7.1. Limited, Conditional, and Revocable License Granted to Users

 

7.1.1. Subject always to your strict and continuous compliance with all applicable terms, conditions, policies, rules, guidelines, and any and all laws governing the use of Guardian Muslim Marriage, including but not limited to these Terms of Service and any additional agreements that may be incorporated by reference, Guardian Muslim Marriage hereby grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable, personal, and royalty-free license to access and utilize the Platform, its associated services, features, functionalities, and proprietary technology strictly for purposes that are in accordance with these Terms.

 

7.1.2. This limited license shall not be construed as conferring upon you any ownership, proprietary interest, or vested rights in or to any part of the platform, including but not limited to its software, content, trademarks, databases, algorithms, interfaces, designs, trade secrets, or any other intellectual property, whether registered or unregistered. It merely provides you with a conditional right to utilize the platform and its services as expressly permitted herein, and only for as long as you comply with all applicable obligations.

 

7.1.3. In the event of any breach, violation, infringement, misuse, unauthorized exploitation, or non-compliance with these Terms or any governing law, this license shall be deemed immediately revoked without prior notice. Upon revocation, you must cease all use of the platform, remove any stored copies or derivatives of platform content, and refrain from any further access or utilization of Services in any form.

 

7.2. Rights, Licenses, and Permissions Granted to Guardian Muslim Marriage

 

7.2.1. By utilizing Guardian Muslim Marriage, and by submitting, posting, uploading, transmitting, communicating, sharing, or otherwise making available any content, data, information, material, or intellectual property ("User Content"), whether directly or indirectly, to or through the platform, you hereby acknowledge, represent, and warrant that you have all necessary rights, licenses, consents, and authorizations to do so.

 

7.2.2. You further expressly grant Guardian Muslim Marriage, including its affiliates, successors, assigns, licensees, authorized third parties, and designated representatives, an irrevocable, perpetual, worldwide, transferable, sub-licensable, royalty-free, and fully paid-up right and license to store, process, host, reproduce, distribute, publicly display, publicly perform, adapt, translate, reformat, analyze, create derivative works from, incorporate into compilations, advertise, promote, commercialize, monetize, and otherwise utilize, exploit, and make available your User Content in any manner or form, through any medium, technology, platform, system, or distribution channel now known or hereafter developed.

 

7.2.3. This grant of rights shall include, without limitation, any and all content that you submit through direct uploads, textual communications, multimedia materials, social media integrations, third-party platform linkages, or other user-generated submissions. You acknowledge that Guardian Muslim Marriage shall have the right, but not the obligation, to modify, translate, edit, adjust, or remove any content submitted by you at its sole and absolute discretion without prior notice.

 

7.2.4. You further acknowledge and agree that, while Guardian Muslim Marriage does not claim ownership over your User Content, the creation of derivative works or adaptations that incorporate or reference your content shall be the exclusive property of Guardian Muslim Marriage, with all associated rights reserved. This includes, but is not limited to, any promotional material, excerpts, screenshots, platform demonstrations, analytical reports, or other commercial applications that may arise through the operation, enhancement, or marketing of the platform.

 

7.3. Authorization for Enforcement Against Unauthorized Use

 

7.3.1. To the extent necessary for the enforcement and protection of your User Content, and subject to applicable laws, you hereby expressly authorize Guardian Muslim Marriage to take such measures as it deems appropriate, at its sole discretion, to prevent unauthorized use, reproduction, dissemination, or exploitation of your User Content by third parties.

 

7.3.2. This may include, but is not limited to, the issuance of Digital Millennium Copyright Act (DMCA) takedown notices, cease-and-desist letters, copyright infringement claims, or any other protective or enforcement action permitted under law.

 

7.3.3. Notwithstanding the foregoing, Guardian Muslim Marriage assumes no duty or obligation to take any specific action to enforce your rights or to prevent third-party misuse of your content, and Guardian Muslim Marriage shall not be liable for any failure or refusal to take enforcement action.

 

7.4. Consent to Advertising, Commercialization, and Data Use

 

7.4.1. As a condition of your access and use of Guardian Muslim Marriage, you expressly agree and consent to the placement, display, incorporation, or dissemination of advertising, promotional content, sponsored materials, commercial messages, and other monetized content within or in connection with the platform and its services.

 

7.4.2. Such advertising and commercial content may be generated by Guardian Muslim Marriage, its affiliates, advertisers, marketing partners, or other third-party collaborators, and may be presented in conjunction with user-generated content, including your own, without any obligation of prior notice or compensation to you.

 

7.4.3. Furthermore, any voluntary suggestions, ideas, feedback, recommendations, feature requests, improvements, or enhancements that you provide to Guardian Muslim Marriage in relation to its services shall be deemed non-confidential and non-proprietary. You hereby grant Guardian Muslim Marriage an unrestricted, perpetual, irrevocable, worldwide, royalty-free, and fully sublicensable right to use, incorporate, modify, distribute, or otherwise exploit such feedback without any obligation to compensate or credit you.

 

7.5. Authority to Retain, Disclose, and Comply with Legal Processes

 

7.5.1. You acknowledge and agree that Guardian Muslim Marriage may access, preserve, retain, use, or disclose your User Content, personal data, account information, and any related records if required to do so by applicable laws, regulatory directives, legal proceedings, or law enforcement requests.

 

7.5.2. In addition, Guardian Muslim Marriage reserves the right to take such actions upon a good faith belief that such access, preservation, use, or disclosure is reasonably necessary to comply with applicable legal obligations, law enforcement requests, court orders, or regulatory requirements.

 

7.5.3. You further understand that Guardian Muslim Marriage shall exercise sole and absolute discretion in determining whether, when, and how to undertake such disclosures, and that such actions shall not be deemed to constitute a breach of any confidentiality obligations or user rights.

 

  1. TERMINATION OF ACCOUNT AND REMEDIES

8.1 Termination by User

 

You may elect to terminate your Account at any time by accessing the "Settings" tab within the Platform, selecting the "Delete Account" option, and following the on-screen instructions to complete the deletion process. Please note that terminating your Account does not automatically cancel or manage any External Service Purchases or recurring subscriptions obtained through third-party platforms such as iTunes or Google Play. You must independently manage or cancel such subscriptions through the respective external service provider to prevent continued billing.

 

8.2 Termination by Us

 

We reserve the right, at our sole discretion, to investigate, suspend, or permanently terminate your Account if we determine that you have breached any provision of these Terms, engaged in conduct that constitutes misuse of the Services, or otherwise acted in a manner that we deem inappropriate, unlawful, or detrimental to the safety and integrity of our platform. Such termination may occur without prior notice and without liability to you. In addition, we may make use of any available personal, technological, or legal means to enforce these Terms, including, but not limited to, restricting access to our Services or seeking further legal recourse where applicable.

 

8.3 General Misconduct and Malfeasance

 

In addition to specific breaches of these Terms, we consider General Misconduct and Malfeasance as encompassing a broad range of behaviors, both on and off our platform, which may warrant termination of your Account and other remedial measures. Guardian Muslim Marriage includes, but is not limited to:

 

(a) Engaging in fraudulent activity, including creating multiple accounts for deceptive purposes, impersonating another individual or entity, or using the Services to conduct unlawful transactions.

 

(b) Posting, sharing, or distributing content that is offensive, defamatory, obscene, discriminatory, threatening, or otherwise violates the rights of other users or third parties.

 

(c) Harassing, stalking, bullying, or engaging in any form of abusive behavior towards other users, whether through the platform’s messaging system, in-person meetings facilitated by the platform, or through external communication methods such as text messages, direct messaging platforms, or social media.

 

(d) Violating the privacy, confidentiality, or security of other users, including the unauthorized sharing of personal information, screenshots of private conversations, or attempting to hack, exploit, or manipulate platform security features.

 

(e) Using the platform for any activity that is illegal under applicable law, including but not limited to solicitation of prostitution, human trafficking, financial scams, or other criminal enterprises.

 

(f) Making false or malicious reports against other users, submitting misleading appeals, or engaging in any behavior intended to manipulate the platform’s moderation or enforcement processes.

 

(g) Exhibiting behavior in offline interactions that, if reported to us, would be deemed inappropriate or unsafe, including allegations of assault, harassment, coercion, or any other conduct that threatens the well-being of another user.

 

8.4 Remedies and Consequences of Termination

 

In the event that we determine, in our sole discretion, that you have engaged in a breach of these Terms or demonstrated conduct falling under Guardian Muslim Marriage, we may take one or more of the following actions:

 

(a) Issue a warning to your registered email address regarding the nature of the violation; 

 

(b) Remove or restrict access to specific content that you have posted;

 

(c) Suspend or permanently terminate your Account and any associated profiles;

 

(d) Revoke any active subscriptions or benefits, without refund or reimbursement;

 

(e) Report your conduct to law enforcement authorities where necessary and cooperate with any legal investigations; and/or

 

(f) Take any additional measures that we, in our absolute discretion, deem necessary to protect the integrity of the platform and its users.

 

8.5. No Right to Appeal in Certain Cases

 

While we generally provide users the opportunity to appeal moderation decisions, we reserve the right to refuse appeals in cases where the violation is deemed severe, including but not limited to criminal conduct, repeated offences, or instances where allowing continued access to the platform would pose a risk to other users.

 

8.6 Survival of Terms Post-Termination

 

8.6.1. If your Account is terminated by you or by us for any reason, these Terms will continue to remain enforceable between you and us. Provisions that, by their nature, should survive termination shall do so, including but not limited to ownership rights, indemnities, disclaimers of warranties, and limitations of liability. Your personal information will be maintained or deleted in accordance with our Privacy Policy.

 

8.6.2. By using our Services, you acknowledge that we retain sole discretion in determining violations of these Terms and enforcing appropriate remedial actions. You agree that we shall not be held liable to you or any third party for the suspension, restriction, or termination of your access to the Services.

 

  1. BACKGROUND CHECKS AND IDENTITY VERIFICATION

9.1 Background Checks

 

9.1.1. In certain circumstances, including but not limited to situations where reports, whether formal or informal, are received from users of the platform, third parties, media sources, government authorities, regulatory bodies, law enforcement agencies, or any other publicly accessible sources indicating potential misconduct, inappropriate behavior, suspected criminal activity, or any conduct that may, directly or indirectly, pose a risk to the integrity, security, reputation, or lawful operation of the platform, we expressly reserve the right, but do not assume any obligation, to initiate inquiries into whether a user has a criminal history, past convictions, or any other record of unlawful behavior that may be deemed relevant in our sole and absolute discretion. Such inquiries may involve, but are not limited to, reviewing publicly available databases, engaging third-party background check service providers, consulting law enforcement registries, examining criminal conviction records, searching sex offender registries, or utilizing any other legally accessible sources of public information that may assist in assessing the risk posed by a particular user.

 

9.1.2. Notwithstanding the foregoing, users expressly acknowledge and agree that any such reviews, if conducted at our discretion, are inherently limited in scope, accuracy, and effectiveness. Due to the varied availability of criminal records across different jurisdictions, as well as potential discrepancies in how such records are maintained, stored, and updated, there exists no guarantee that any particular search will yield comprehensive, current, or reliable results. Users further acknowledge that the absence of any publicly available record of criminal conviction does not constitute a representation, warranty, or guarantee that a particular individual has never engaged in unlawful, unethical, or harmful conduct, nor does it imply an endorsement of any user’s character, behavior, or suitability for interacting with other users on or off the platform.

 

9.1.3. In the event that we, through any means deemed appropriate in our sole and absolute discretion, identify or receive confirmation that a user has been convicted of a criminal offence, including but not limited to crimes such as sexual offences, human trafficking, stalking, kidnapping, child abuse, domestic violence, homicide, terrorism, hate crimes, violent extremism, or any other offence that, in our sole judgment, may be indicative of a risk to the safety and security of other users, we reserve the right to take any action deemed necessary, appropriate, or advisable. Such action may include, without limitation, imposing restrictions on a user’s account, implementing temporary or permanent suspensions, or terminating a user’s access to the platform entirely, with or without prior notice, justification, or recourse. The determination of what constitutes an offence warranting action shall rest solely with us and shall not be subject to appeal, challenge, or review by the affected user or any third party.

 

9.1.4. Users expressly understand, acknowledge, and agree that we assume no duty, responsibility, or obligation to conduct background checks on any user, whether at the time of registration, during the course of their use of the platform, or at any later stage. Furthermore, we expressly disclaim any and all liability for any reliance placed by any party on the existence, absence, accuracy, or results of any background check, whether conducted by us or by any third party. Users are strongly encouraged to exercise their own independent judgment, take appropriate precautions, and remain vigilant when engaging with other users, whether through the platform or in any other setting.

 

9.2 Identity Verification

 

9.2.1. In order to access, register for, and utilize the platform, all users must meet the minimum age requirement, which is 18 years of age or the legal age of majority in their country, state, or jurisdiction of residence, whichever is greater. By using the platform, users represent and warrant that they satisfy this requirement and that all information provided during the registration process, including but not limited to their name, date of birth, and identification details, is truthful, accurate, complete, and not misleading in any way. Users acknowledge that any misrepresentation or failure to comply with this requirement may result in immediate suspension or termination of their account at our sole discretion.

 

9.2.2. We reserve the right, but do not undertake any obligation, to take proactive measures to verify the identities and ages of users, either at the time of account creation or at any point thereafter, through methods including, but not limited to, requesting government-issued identification documents, conducting biometric or facial recognition verification, cross-referencing publicly available information, or implementing other technological or procedural measures that we may deem necessary to ensure compliance with age requirements.

 

9.2.3. If, at any time, we have reason to suspect that a user has misrepresented their age or identity, whether through direct reports, internal monitoring, technological detection, or third-party verification services, we reserve the right to request additional verification, place a temporary hold on the user’s account, or take any other action that we deem appropriate under the circumstances. If a user fails to comply with verification requests within the time frame specified, provides false or misleading information, or is determined, in our sole judgment, to be ineligible to use the platform, we may permanently suspend or revoke access without prior notice or further explanation.

 

9.2.4. Users acknowledge and agree that identity verification measures, while intended to enhance security and compliance, are not infallible and may not prevent all instances of misrepresentation, fraud, or unauthorized access. Accordingly, we make no representations, warranties, or guarantees regarding the accuracy, completeness, or effectiveness of any verification method. Users agree that they shall not rely on the identity verification status of any other user as an assurance of authenticity, legitimacy, or safety.

 

9.2.5. By using the platform, users acknowledge and accept that we retain full and absolute discretion in determining whether a user meets the eligibility, verification, and security requirements necessary to continue accessing or utilizing the platform. We further reserve the right to modify, expand, suspend, or discontinue any background check or identity verification measures at any time, with or without prior notice, as we deem necessary or advisable to protect the integrity of the platform and its users. Under no circumstances shall we be held liable for any consequences arising from the implementation, modification, or absence of such measures.

 

  1. LIMITATION OF LIABILITY

10.1 General Limitation

 

To the maximum extent permitted by all applicable laws, rules, and regulations governing liability and consumer protection, we expressly limit our liability in connection with the platform and any associated services, features, or functionalities provided thereunder. This limitation applies to all possible legal bases of liability, including but not limited to contractual claims, tort claims, negligence, strict liability, statutory liability, or any other legal theory of responsibility.

 

10.2. Exclusion of Certain Damages

 

To the fullest extent permitted by applicable law, under no circumstances shall Guardian Muslim Marriage, its affiliates, subsidiaries, directors, officers, employees, agents, licensors, service providers, or any other associated entity be held liable for any direct, indirect, consequential, exemplary, incidental, special, punitive, multiplied, fixed, or enhanced damages. This includes, without limitation, any loss of business, revenue, profits (whether direct or indirect), contracts, goodwill, anticipated savings, data, use, reputation, or any other intangible losses, regardless of whether such damages were foreseeable or whether Guardian Muslim Marriage was advised of the possibility of such damages.

 

10.3. Scope of Limitation

 

Without prejudice to the generality of the foregoing, and to the fullest extent permitted by applicable law, Guardian Muslim Marriage shall not be responsible or liable for any damages, losses, or claims arising from:

 

10.3.1. Service Access and Use

 

Any inability, failure, interruption, suspension, or termination (whether temporary or permanent) in accessing, using, or benefitting from the platform, irrespective of the reason, whether due to technical issues, outages, system errors, third-party interference, security vulnerabilities, or any other cause beyond our reasonable control.

 

10.3.2. User and Third-Party Conduct 

 

The conduct, actions, statements, representations, or content of any other user or any third party on or through the platform, including but not limited to misleading, offensive, defamatory, harmful, infringing, fraudulent, or unlawful conduct or content, regardless of whether such content was reviewed, approved, or monitored by Guardian Muslim Marriage.

 

10.3.3. Unauthorized Access or Use

 

Any unauthorized access, use, modification, or alteration of your data, communications, information, or content, whether caused by hacking, security breaches, technological malfunctions, third-party misconduct, or other acts beyond our reasonable control.

 

10.3.4. Loss or Corruption of Data

 

Any loss, corruption, destruction, or unintended disclosure of user data, personal information, or any other digital content arising from technical failures, cyberattacks, accidental deletions, or any other reason.

 

10.3.5. Third-Party Services and Content 

 

Any reliance on, use of, or inability to use third-party services, applications, software, or content that may be linked to or integrated with the platform, including any errors, inaccuracies, delays, or failures in such third-party offerings.

 

10.4. Monetary Cap on Liability

 

To the fullest extent permitted by law, in no event shall Guardian Muslim Marriage's total aggregate liability to any user, whether arising in contract, tort, negligence, statute, equity, or otherwise, exceed the greater of:

 

(a) One Hundred United States Dollars (USD $100); or

 

(b) The total amount of fees, if any, paid by the user to Guardian Muslim Marriage for the use of services during the twenty-four (24) month period immediately preceding the date the user first initiates any form of legal action, arbitration, or other dispute resolution proceedings against Guardian Muslim Marriage, its affiliates, or any related parties.

 

10.5. Application of Limitation Regardless of Legal Basis

 

The limitations and exclusions set forth in this Clause 10 shall apply under all circumstances, irrespective of:

 

(a) Basis of Liability: Whether the liability is based on contract, tort (including negligence), statutory duty, misrepresentation, restitution, breach of fundamental terms, or any other legal theory.

 

(b) Nature of Alleged Breach: Whether the alleged breach involves direct, indirect, consequential, punitive, special, or incidental damages.

(c) Failure of Remedies: Whether any remedy provided under this Agreement or under law fails in its essential purpose or is deemed inadequate in law or equity.

 

 

10.6. Jurisdictional Exceptions

 

Certain jurisdictions do not permit limitations on certain types of damages, disclaimers of liability, or exclusions of implied warranties. If any applicable law in a particular jurisdiction prohibits any portion of this Clause 10 from applying to you, then such portion shall be deemed modified to the minimum extent necessary to comply with such law, and all remaining provisions shall remain in full force and effect.

 

  1. INDEMNITY

11.1. Comprehensive Indemnification Obligation

 

You as the user of Guardian Muslim Marriage’s platform, expressly acknowledge, understand, and agree that you are solely and entirely responsible for your actions, conduct, and any content, material, information, or communications that you post, share, submit, transmit, or otherwise make available on or through the platform. As such, and to the fullest extent permitted by applicable law, you shall unconditionally and irrevocably indemnify, defend, release, and hold harmless Guardian Muslim Marriage, its parent companies, affiliates, subsidiaries, licensors, partners, service providers, contractors, officers, directors, shareholders, employees, agents, representatives, successors, and assigns (collectively referred to as the "Indemnified Parties") from and against any and all claims, demands, complaints, allegations, actions, proceedings, suits, investigations, liabilities, obligations, damages (including actual, consequential, special, punitive, exemplary, and incidental damages), losses, judgments, settlements, costs, expenses, fines, penalties, and legal fees (including but not limited to attorneys’ fees and disbursements) of any kind or nature whatsoever, whether foreseeable or unforeseeable, suffered, incurred, or otherwise imposed upon the Indemnified Parties, arising directly or indirectly from, in relation to, or in connection with:

 

(a) Your Conduct: Any act, omission, negligence, recklessness, misrepresentation, willful misconduct, or violation of duty committed by you, whether intentionally or unintentionally;

 

(b) Use of the Platform: Your access to, use of, or inability to use the platform, including any misuse, abuse, misrepresentation, or any act that causes harm or disruption to Guardian Muslim Marriage, other users, or third parties;

 

(c) User-Generated Content: Any content, materials, statements, representations, assertions, images, videos, audio files, links, or other materials posted, submitted, uploaded, transmitted, disseminated, or shared by you, including but not limited to content that is defamatory, infringing, offensive, harmful, unlawful, or misleading;

 

(d) Breach of Terms: Any actual or alleged breach of these Terms by you, including any additional policies, rules, or guidelines incorporated herein;

 

(e) Violation of Rights: Any actual or alleged infringement, misappropriation, or violation of any intellectual property, privacy, proprietary, contractual, or legal rights of any third party by you;

 

(f) Violation of Laws: Any actual or alleged breach, contravention, or violation of any local, state, provincial, federal, or international law, regulation, ordinance, rule, decree, or judicial or administrative order by you.

 

11.2. Absolute Right to Settle Claims

 

Guardian Muslim Marriage shall have the sole and exclusive right, in its absolute and unfettered discretion, to assume, control, settle, compromise, negotiate, discharge, or resolve any claim, demand, action, proceeding, suit, or cause of action brought against it, without any obligation to obtain your prior consent or approval. Under no circumstances shall you, without the express prior written consent of Guardian Muslim Marriage, settle or resolve any claim that is subject to indemnification under this Clause 11.

 

11.3. Cooperation in Defense

 

You agree, upon request, to fully and promptly cooperate in good faith with Guardian Muslim Marriage and its legal representatives in the defense of any claim, dispute, proceeding, or investigation arising from or relating to any matter covered by this indemnity. Such cooperation shall include, but is not limited to, providing relevant documents, information, and testimony as reasonably required by Guardian Muslim Marriage.

 

11.4. Irrevocable and Unrestricted Indemnification

 

Your indemnification obligations under this Clause 11 are absolute, continuous, irrevocable, and shall apply in all circumstances, regardless of whether Guardian Muslim Marriage has been negligent or otherwise at fault. Your obligation to indemnify shall survive the termination of these Terms, your account, and your use of the platform.

 

11.5. Jurisdictional Limitations

 

To the extent that any applicable law limits or prohibits certain indemnification provisions, this Clause 11 shall be construed and enforced to the maximum extent permitted under applicable law, and any invalid or unenforceable portion shall not affect the validity or enforceability of the remainder of this Clause 11.

 

  1. ACCEPTANCE OF TERMS

12.1. Binding Nature of Agreement

 

By accessing, utilizing, engaging with, or otherwise interacting with the Services, you irrevocably, unconditionally, and unequivocally acknowledge, accept, and agree to be bound by the following, each of which is incorporated by reference and forms an integral and inseparable part of this Agreement:

 

(a) These Terms, which may be unilaterally modified, amended, supplemented, varied, or replaced by Guardian Muslim Marriage from time to time at its absolute discretion;

 

(b) Guardian Muslim Marriage’s Privacy Policy, Cookie Policy, Community Guidelines, and any other codes of conduct, notices, advisories, or policies implemented, published, or otherwise communicated by Guardian Muslim Marriage; and/or

 

(c) Any and all Additional Terms that may be applicable to specific purchases, subscriptions, premium services, or other paid engagements with Guardian Muslim Marriage, whether explicitly agreed upon or implied by your continued use of the Services.

 

12.2. Non-Acceptance and Prohibited Use

 

If you, for any reason whatsoever, do not accept, acknowledge, or agree to be fully and unconditionally bound by the entirety of this Agreement, including all of its constituent terms, conditions, policies, and supplementary provisions, then you are expressly prohibited from accessing, using, or continuing to engage with any portion of the Services in any manner whatsoever. Any unauthorized use of the Services in contravention of this clause shall be deemed a material breach of this Agreement, entitling Guardian Muslim Marriage to pursue any and all available legal, equitable, or injunctive remedies.

 

12.3. Interpretation of Pronouns and Terminology

 

Unless expressly stated otherwise or required by the specific context, all pronouns, and their respective variations, shall be deemed to refer to and encompass all applicable genders (masculine, feminine, neuter), grammatical numbers (singular, plural), and entities (natural persons, corporate bodies, statutory bodies, trusts, associations, partnerships, and any other legal or quasi-legal structures, whether recognized at law or in equity). Any term that is undefined within these Terms but is defined elsewhere in an applicable statute, regulation, or policy shall be construed in accordance with the relevant legislative or regulatory definition.

 

  1. ENTIRE AGREEMENT

13.1. Supersession of Prior Agreements

 

This Agreement, which includes but is not limited to these Terms, the Privacy Policy, Cookie Policy, Community Guidelines, and any applicable Additional Terms, constitutes the sole, complete, and exclusive agreement between you and Guardian Muslim Marriage concerning the access to and use of the Services, and it expressly supersedes, replaces, and extinguishes any and all prior discussions, negotiations, agreements, representations, warranties, understandings, and arrangements, whether written, oral, express, or implied, that may have previously existed between you and Guardian Muslim Marriage in relation to the subject matter hereof.

 

13.2. Severability of Provisions

 

In the event that any provision, clause, sentence, paragraph, or section of this Agreement is deemed invalid, illegal, void, or otherwise unenforceable, in whole or in part, by a competent court, tribunal, regulatory authority, or other adjudicatory body, such determination shall not affect the validity, legality, or enforceability of the remainder of this Agreement, which shall continue to operate in full force and effect to the maximum extent permitted under applicable law. The parties further agree that any such invalid provision shall be replaced by a legally enforceable provision that most closely reflects the original intent of the parties.

 

13.3. No Waiver of Rights

 

The failure, delay, or omission by Guardian Muslim Marriage to exercise, enforce, or assert any right, remedy, power, or privilege under this Agreement shall not be construed as a waiver, relinquishment, or abandonment of such right, remedy, power, or privilege. Any single or partial exercise of a right, remedy, power, or privilege shall not preclude any further or subsequent exercise thereof. No waiver shall be effective unless made in writing and duly executed by an authorized representative of Guardian Muslim Marriage.

 

13.4. Non-Transferability and Assignment

 

You acknowledge and agree that your rights, obligations, privileges, and entitlements under this Agreement, including but not limited to any rights associated with your account, subscription, content, or interactions within the Services, are strictly personal to you and may not be assigned, delegated, sublicensed, encumbered, or otherwise transferred, whether voluntarily or involuntarily, without the express prior written consent of Guardian Muslim Marriage. Any attempted assignment, delegation, or transfer in violation of this provision shall be null, void, and of no effect. Conversely, Guardian Muslim Marriage retains the unrestricted and absolute right to assign, transfer, delegate, or otherwise dispose of its rights and obligations under this Agreement, in whole or in part, without prior notice or consent.

 

13.5. No Special Relationship or Authority

 

Nothing in this Agreement shall be construed as creating any agency, partnership, joint venture, fiduciary, employment, or other special relationship between you and Guardian Muslim Marriage. You shall have no authority whatsoever to act on behalf of, bind, or otherwise represent Guardian Muslim Marriage in any manner, and you shall not purport to do so. Any such unauthorized representation, whether express or implied, shall be deemed a material breach of this Agreement and may result in immediate termination of your access to the Services, in addition to any other remedies available to Guardian Muslim Marriage at law or in equity.

 

13.6. Termination Upon Death

 

Upon your death, all rights, licenses, and entitlements associated with your account, including access to and use of the Services, shall immediately and automatically terminate, unless otherwise expressly provided for under applicable law. Guardian Muslim Marriage reserves the right to take any and all necessary actions to effectuate the closure or suspension of your account, including but not limited to the deletion, archiving, or retention of any associated data in accordance with its prevailing data retention policies and applicable legal obligations.

 

  1. GOVERNING LAW AND JURISDICTION

14.1. Applicable Law

 

To the maximum extent permitted by applicable law, this Agreement, including all terms, conditions, rights, obligations, and any disputes, controversies, or claims arising out of or relating thereto, including its formation, interpretation, performance, breach, termination, or enforcement (collectively referred to as the "Disputes"), shall be governed by and construed exclusively in accordance with the laws of the jurisdiction in which Guardian Muslim Marriage is incorporated, without regard to any conflict of law principles that would result in the application of the laws of another jurisdiction.

 

14.2. Exclusive Jurisdiction and Forum Selection

14.2.1. Jurisdictional Submission

 

Any and all claims, actions, suits, or proceedings arising out of, related to, or in connection with this Agreement that, for any reason, are not resolved through arbitration or other alternative dispute resolution mechanisms shall be submitted exclusively to the courts of competent jurisdiction in Dallas County, Texas.

 

14.2.2. Personal Jurisdiction and Venue

 

You irrevocably and unconditionally consent to submit to the personal jurisdiction of and venue within the courts specified in Clause 14.2.1 and waive any and all objections based on forum non-convenient, improper venue, or lack of personal jurisdiction.

 

14.3. Non-Applicability of Certain Consumer Protections

 

To the extent that mandatory consumer protection laws in your jurisdiction explicitly prohibit the application of the governing law chosen in this Clause 14, this Clause shall be deemed modified solely to the extent necessary to comply with such mandatory provisions, and all other provisions shall continue in full force and effect.

 

14.4. No Class Actions

 

To the fullest extent permitted by applicable law, you agree that you shall not initiate, participate in, or be represented in any class action, collective action, or representative proceeding against Guardian Muslim Marriage. Any claims brought against Guardian Muslim Marriage shall be conducted solely on an individual basis.

 

14.5. Enforceability of Arbitration Provisions

 

If any dispute arises regarding the enforceability or applicability of any arbitration provisions contained in this Agreement, such disputes shall be litigated exclusively in the courts designated under Clause 14.2.

 

  1. AMENDMENTS AND MODIFICATIONS TO THESE TERMS

15.1. Right to Modify Terms

 

Guardian Muslim Marriage reserves the absolute and unequivocal right, at its sole and exclusive discretion, to amend, modify, supplement, alter, revise, update, or otherwise change any provision, clause, or section of these Terms at any time, for any reason, with or without prior notice to you, and without any obligation to obtain your consent, subject only to any mandatory requirements under applicable laws. Such modifications, amendments, or changes (collectively referred to as the “Modifications”) may be undertaken by Guardian Muslim Marriage in response to, but not limited to, evolving business needs, technological advancements, legal or regulatory updates, changes in industry standards, modifications to our Services, or any other reason deemed necessary or appropriate by Guardian Muslim Marriage in its sole judgment.

 

15.2. Notice of Changes

 

In the event that Guardian Muslim Marriage makes any Modifications to these Terms, we shall, at our discretion, provide notice of such Modifications in a manner we determine appropriate, which may include, but is not limited to, any one or more of the following methods:
(a) Posting the revised Terms on our platform, website, mobile application, or any other digital or physical medium through which our Services are offered, with the date of the most recent update clearly indicated;

 

(b) Notifying users via an in-app notification, push notification, or any other communication method facilitated by our platform;

 

(c) Sending an email, SMS, or other electronic communication to the contact information you have provided to us; and/or

 

(d) Displaying a notice upon login or requiring explicit acceptance of the new Terms before allowing further access to our Services.

 

15.3. User Responsibility to Stay Informed

 

It is your sole and exclusive responsibility, as a user of our Services, to review these Terms periodically to ensure that you are aware of any Modifications. Your continued access to, use of, interaction with, or engagement with our platform, application, or any other Services after the effective date of any Modifications shall constitute your full and irrevocable acceptance of such revised Terms, and you shall be legally bound by the updated provisions. If, at any time, you do not agree with any Modification, you must immediately cease all use of our Services, delete your account, and discontinue any and all interaction with Guardian Muslim Marriage.

 

15.4. No Liability for Modifications

 

To the fullest extent permitted by applicable laws, Guardian Muslim Marriage shall not, under any circumstances, be held liable, responsible, or accountable for any loss, damage, inconvenience, detriment, claim, liability, expense, or adverse consequence, whether direct or indirect, arising from or relating to any Modification to these Terms, including but not limited to situations where a user fails to review the updated Terms or continues to use the Services without being aware of a Modification.

 

15.5. Binding Nature of Amendments

 

By using our Services, you acknowledge and agree that Guardian Muslim Marriage has the absolute right to unilaterally modify these Terms and that such modifications shall be legally binding upon you upon their publication. You further acknowledge that any failure on your part to review the Terms shall not be construed as a defense against their enforceability. Your continued use of our Services constitutes conclusive evidence of your full acceptance of the revised Terms.

 

15.6. Severability and Survival

 

If any provision within this Clause 15, or any portion thereof, is determined to be invalid, unlawful, or unenforceable under applicable law, such determination shall not affect the validity, legality, or enforceability of any remaining provisions, which shall continue in full force and effect. The provisions of this Clause 15 shall survive any termination, suspension, or discontinuation of your use of the Services.

 

  1. DISCLAIMER

 

16.1. The Platform including all content made available by us on the Platform, as well as any content provided by members or users of the Platform, are provided on an "as is" and "as available" basis. We do not make, and hereby expressly disclaim, any and all representations and warranties of any kind, whether express or implied, including, but not limited to, any warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, or uninterrupted operation. Furthermore, and without limiting the foregoing, we do not make any representations, warranties, or guarantees, express or implied, regarding the suitability, reliability, or compatibility of any matches that may be suggested or facilitated through the Platform.

 

16.2. To the extent that applicable law does not permit the exclusion of certain express or implied warranties, then we shall be deemed to provide only the minimum level of warranty that is strictly required under the applicable law. However, under no circumstances shall any verbal, written, or otherwise communicated advice, guidance, or information obtained from us, our representatives, or our affiliates, whether through the Platform, or any other means, be construed as creating any warranty, representation, or guarantee beyond what is explicitly stated in this section.

 

16.3. Additionally, we make no assurances, representations, or warranties that access to, or use of, the Platform will be uninterrupted, timely, secure, or free from errors, defects, viruses, or other harmful components. We do not guarantee that the features, functionalities, or services provided through the Platform will meet your expectations, requirements, or intended outcomes. Nor do we make any warranties as to the accuracy, completeness, reliability, or correctness of Our Content, Member Content, or any other information, materials, or communications made available through the Platform. Any reliance you place on such information is strictly at your own discretion and risk.

 

16.4. You acknowledge and agree that your use of the Platform, including but not limited to any interactions, communications, or engagements with other users or members of the platform, is undertaken solely at your own risk and discretion. We do not verify, endorse, or take responsibility for the actions, statements, behaviors, or representations of any user or member. Furthermore, we do not, and have no obligation to, conduct criminal background checks, identity verification, or any other form of screening on individuals who register, access, or participate in the use of the Platform. We expressly disclaim any and all liability arising from or related to any interactions, disputes, or engagements between users, whether conducted on or off the platform.

 

16.5. By using the Platform, you acknowledge and accept the terms set forth in this Disclaimer and agree that you shall have no claims, rights, or remedies against us, our affiliates, partners, licensors, or service providers, in connection with any of the foregoing.
